深度解剖佛州买卖房产过户清单

在2016年之前,全佛州只有一种形式的过户清单叫做HUD(SETTLEMENT STATEMENT)。但是由于政治原因(具体不甚了解),2016年之后发生了改革,过户清单改为了两种形式:对于现金房产交易我们始终称之为HUD;而对于贷款购买的交易改名为了CD(CLOSING STATEMENT)。大家可以根据自己的买卖情况对号入座。
🔹HUD只包含了房产交易中正常的过户费用,而CD 除了包含房产过户费用,还包括银行贷款收取买家的各种费用(评估费,行政费,信用调查费,保险费等);
🔹对于卖家而言,HUD和CD 没有区别(除了格式不一样),数字完全一样;而买家就会有区别(是否包含银行费用);
🔹HUD 和 CD 的清单格式不同(虽然内容相似);
🔹CD的内容会比HUD来的更加繁琐,因为有银行费用的介入;
🔹除了清单以外,CD的过户文件更多(主要是银行方面),HUD只有正常的过户费用。

上文中标记红色字体和“可选择”的内容是关于房产产权调查的内容,产权调查费用到底谁来支付,是可以有选择性的。 合约规定:这些费用既可以是由卖家来支付,也可以由买家来支付;当然也可以双方来分开支付。(合约具体如何规定和选择,请见后文)

谁来支付产权调查方面的费用
在上文提到,合约可以规定由哪一方来支付房产产权方便调查的费用。这点很多买家卖家都很少知道。(如上图所示)这是佛州标准版购房合约中对产权费用规定的条文
选项i: 卖家来指定过户公司并且支付所有产权方面的调查费用,包括产权保险,产权调查,房产抵押调查
选项ii:买家来指定过户公司并且支付所有产权方面的调查费用,包括产权保险,产权调查,房产抵押调查
选项iii:(也是目前最大众的选项)根据郡县规定,买家来指定过户公司并且购买产权保险;卖家来承担产权调查和房产抵押调查的费用。换句话说,买卖双方来不平均分摊这些花费。

对于大部分买家和卖家来说签署合约应该是最兴奋也是最紧张担心的时刻,客户在要买/卖房子的同时,对合约的不熟悉可能会使很多人小紧张一把。今天我们就请FTP团队的金牌房产经纪李梦超为大家详细解读一下二手房合约,帮助大家在最短的时间内去了解最重中之重的内容。
精读合约和精读一本书有共同之处,那就是遵循二八法则,意思是说一本书里面可能20%的内容是最重要的,它可能会涵盖80%的重点信息和文章要义。这点在购房合约中依然通用(虽然是英文版本,但是法则相同)。
佛州购房合约是由政府通过房产委员会所出台的统一购房合约,其中很多很多的条款内容都是政府约定俗成的东西,这部分就是前文所说的不那么重要的内容,里面包含了很多条款都已经确定了的条款,不管是谁签署协议,这些条款的内容不能被改变。通常这些条款是非黑即白的条款,为的是不产生歧义和模糊概念。所以像这种条款,我们没有必要去了解细则;而刨除固定条款之后剩下的就是我们需要详细了解的重要内容了,这部分内容是需要买卖双方商讨和填写的,也是今天我们要跟大家着重介绍的部分。
合约类型
佛州购房合约分为两个版本一个是CRSP 版本,另一个是 FAR BAR 版本。在目前的市场上,99%的交易合约会采用第二种 Far Bar 也就是As Is 的合约类型。
As Is 合约简单翻译过来是指:卖家卖的是现状下的房产,卖家有权利不对房子的现状负责;而买家有权利自行去检查房屋质量并决定是否要购买。 这种合约的好处是大大的缩短的购房时间和购房中因为房子状况达不成共识而造成的繁琐的步骤。
合约条款
由于买卖合约有固定的模板,所以这对我们了解合约内容提供了极大的便利,下面就让我们详细的解读一下合约中对于我们最重要的部分:
第1-2行——规定了买卖双方的名字。请注意这里一定是客户证件上的姓名。
第7-10行——对目标房产的信息进行描述,包括房产地址、所在郡县、法律描述等。
第15-23行——房屋内部什么是卖的,什么是不卖的。举例:一般情况下,与房屋墙体固定相连的东西,不容易移动的东西是包含在交易价格里的,包括但不限于冰箱,固定式微波炉,固定式烤箱,洗碗机,洗衣机,烘干机等。 什么是一般不带的呢? 举例:窗帘,家具等可移动或者好移动的家具和家电。
第26-42行——这几行内容是整个合约的重中之重,包括了房产的价格、支付定金多少和时间点、过户公司的指定、贷款额度多少和过户当天余额。 其中定金一般情况下是分两次支付,支付到买家指定的第三方监管账户(属于过户公司),第一笔定金一般是合约开始后的48小时内支付金额$1000;第二笔定金是合约开始后的7-10天之内支付金额10%的房价。过户公司一般是由买家指定的。
第43-52行——对合约开始时间和结束时间的规定。一般情况下,是买家先签字递交这份合约给卖家并给与24-48小时考虑时间;对于现金交易25-30天即可完成,对于贷款交易45-60天即可完成。买卖双方可以根据此时间段并结合自身情况来定时间。
第81-124行——确定现金支付还是贷款。其中最重要的是81-87行,买家可以在这里选择是现金,还是贷款购买。如果是贷款,可以填写贷款种类(conventional,VA,FHA,可以咨询贷款律师),贷款利率大概是多少,贷款时长和确定贷款时间。
【温情提示】这里面需要注意的是确认贷款的时长,大众状况是买家要在30天内确定下来银行是否会确认贷款(loan approval)。如果30天内没有拿到贷款但是也没有通知卖家,那么买家违约,损失所有抵押金;如果30天内买家给出银行拒绝信的话,合约可以合理取消。如果30天内,银行没有完成审批,买家也可以申请延期。
第158-172行——约定谁来指定过户公司和支付相关产权调查的费用。一般情况下,是买家来指定过户经纪人,而产权方面的调查费用是卖家来支付。而过户费用是买家付买家的,卖家付卖家的。
【注意】即使是同在佛州,不同地区之间在这个费用支付方面也可能有所不同。
第248-289行——尽职调查的时长。尽职调查的时间一般是在7-10天,最多不超过15天,这段时间我也称之为反悔期。在规定时间内,客户可以请专业检房人士来对房子从里到外,从上到下做一个全面的房屋检查,包括屋顶,电力,家电,下水道和其他。 如果房屋状况不佳,可以和卖家沟通,看是否卖家同意承担一些大的维修或者降价,但是由于我们是 as is 的合约,卖家可以拒绝提供维修或降价。
【温情提示】个人建议:注重避轻。对于大的问题,一定要和卖家交涉,比如说屋顶漏水,电力系统老化,空调停止工作等;对于小的问题,只要是不影响使用的和可以简单搞定的问题,可以选择接受。但是不管是卖家维修还是降价,这个商讨过程必须要在指定的反悔期内提出来并且讨论。在反悔期外提出问题,卖家有权利不接受任何讨价还价。同时,在反悔期内,即使房屋问题不大,买家也可以单方面以任何理由撤销合约。
第569行——附属文件列表。在交易中,除了AS IS是主合同以外,还会需要一些附属合同来辅助双方协商条款。 这里的附属文件很多,但是常用的无非只有3-4个。
第571行——开放性附加条款,如果买卖双方想要商讨的内容不在合约范围内,那么可以由双方经纪人拟草在这里面。
如何签字
合约一共是12页,在每一页的左下角买家的简写名,右下角是卖家的简写名,在第12页最后一页除了签简写名,还需要在正文中签写全名。
简写名举例:假设卖家叫李晨光,那么按照英文写法应该是Chenguang Li, 简写名就是 CL;全名可以是Chenguang Li。

1008. Construct Binary Search Tree from Preorder Traversal

Introduction 


It is a medium level tree algorithm. I learn a lesson today and I like to share what I learn. It is so much enjoyment that I find something to work on.

Performance


I wrote the solution in the weekly contest 127, and it took me 52 minutes. I came cross so many errors, stack overflow, and wrong results. I just could not believe that it took me so long.

After the contest, I checked ranking no. 1 - Neal wu's code, and it took him 3 minutes 16 seconds.

What makes huge difference? He just chose to use a list data structure instead of array. He just push the original list into two separate data structure.

I chose to use the array, avoid using extra space. And then there are two user cases. Left child is missing or not missing.

So in other words, it is mindset.

When I practiced tree algorithms last year, I had same issues; it took me over one hour to work on one tree algorithm using array and two indexes to specify subarray.

It is my personal finance research. I have to review my past expense based on citi credit card statement, and I like to find things to work on.

Here is the analysis I prepared and it took me more than two hours to prepare. I need to export those data from statements in pdf file to excel sheet first, and then extract dollar amount, and then add store and category, month and year.




My analysis


I am struggling to build wealth and grow rich. I cannot tell the investment opportunity last 9 years in the city of Vancouver. I rent a place all the time, but I do not find any motivation to go out to purchase rental property when the price is low from 2010 to 2016, city of Surrey, Colverdale, and Chilliwack.

Now my cash in Canada asset is first time high in $50,000 Canadian dollars. I need to push myself to learn how to invest early, and baby step, reduce the risk, and get more experience.

It is my personal finance research. I wonder why I am struggling in my personal finance, and I decide to work on personal finance research. One thing I have to do is to export all transaction from citi bank statements in pdf file to an excel sheet, and then extract the amount for each transaction, add Category column and store column, and then generate report.

I am working on personal finance research. I like to find ideas how to analyze those data. Based on a few more facts, I can tell that there are a few things I should work on.

Step to generate report


1. Download statements from citicards.com
2. Copy and paste all transaction into Excel sheet
3. Run excel script to extra last 5 or 5 chars to get dollar amount
4. Use Excel -> Data -> column from text to number
5. Add more columns like year, month, store, category
6. Apply filter on excel sheet, expedite the work to apply multiple transaction one time.
   Like filter 'publix', apply more than 30 transactions to grocery, store: publix once
7. Work on big purchase item, or multiple purchases expenses first.
8. Work on blank items on category, solve one by one for last 30 or 50 items.

Introduction


It is my personal finance research. I have to work on citi bank credit card 2003, 2004, 2005 monthly analysis, in the same time, I like to replay last night mock interview. I was so amazed that the interviewee's performance, and it was so challenging for me to catch up as an interviewer. This is the first time I met a Stanford computer science graduate.

I have to select top 10 mock interviews from those 150 mock interviews on interviewing.io platform, and then I can replay those videos more often and learn from those interviewees.

I have to work on personal finance research, one thing I have to do is to generate annual report based on citi credit card statements. I like to listen something while I work on book keeping using Excel today, and then prepare reports first. Usually I will tell the problems through those reports later.

I need to learn how to parent myself, discipline, and learn how to invest money, spend needs not wants.

I ask longest univalue path algorithm to warm up the interviewee, and then use a dynamic programming algorithm or depth first algorithm to challenge the interviewee.

Leetcode 1000. Minimum Cost to Merge Stones (greedy algorithm)

Introduction


It is hard level algorithm. I spent over 30 minutes to write a greedy algorithm. I like the experience and also it is good idea to write a blog for the practice.

Greedy algorithm


The greedy algorithm does not work. The counter example is [6, 4, 4, 6]. The greedy algorithm will start from [4, 4] to merge one pile, and then [8, 6], and then [6, 14]. The total cost will be 42. The minimum cost can be generated by not greedy algorithm, starting from [6, 4] to merge one pile 10, and then [6, 4] to merge to one pile 10, and then [10,10] is merged to one pile 20, the total cost will be 40.

Here is my greedy algorithm code.

How to divide into subproblems?


Based on the example [6, 4, 4, 6], K = 2. There are the following three subproblems to solve.

case 1:

subproblem:  array [6, 4, 4], K = 2 -> to K -1 piles
subproblem:  array [6], K = 2   -> to one pile


[6, 4, 4] to merge into one pile, the minimum cost will be 6 + [4, 4] to one pile, 6 + 8 + 8 = 22. So we can conclude that case 1's cost will be 50.

case 2:

subproblem:  array [6, 4], K = 2 -> to K - 1 piles
subproblem:  array [4, 6], K = 2 -> to one pile

case 2's cost will be 40.

case 3:

subproblem:  array [6], K = 2 -> to K - 1 piles
subproblem:  array [4, 4, 6], K = 2 -> to one pile

case 3's cost will be 50.

So the minimum cost will be minimum ( case 1, case 2, case 3).

Good job to explain the recurrence formula. I write the formula by myself in the following:
How to build recurrence formula?
F(n-1) = F(n) - K + 1 <- we merge K piles to one pile. For example, F(n) is the array with length n, then F(n-1) array's length should be n - (K - 1).
F(n-2) = F(n) - K + 1
...
F(1) = F(2) - K + 1
Add above all formula's left item together, right item together. Both sides have common items to remove, F(2), F(3), ..., F(n-1). So left side and right side can be simplified in the following:
F(1) = F(n) - m * (K - 1).
In other words, 1 = n - m * (K - 1).
We can conclude that array's length n, (n - 1)/ (K - 1) = m, which means (n - 1)% (K - 1) == 0.

Introduction


It is the first time I like to write a blog related to my molar tooth extraction. I did extract two molar teeth last six months, and I need to extract one more in short future. They all are my right side.


Tooth is not decoration


I was experienced difficult time to miss four tooth in right side, two up and two down. But compared to suffering last two years, I choose to stay healthy instead of long-term pain. It all started from my lack of preparation to extract the tooth, instead of extraction, I chose to do gum surgery, and the shaking tooth caused the infection. The dentist asked me to go to see a periodontist.

I kept the tooth shaking in my mouth over two year, last November I could not stand any more, the gum infected so badly around two teeth. I decided to visit a different dentist and go back to visit my old dentist more than 6 years ago. After the ten minutes visit, I decided to extract the first tooth in Dec. 2018.

It was too tough to spend two months to wait for the appointment to extract the tooth. It was easy to extract the tooth.

Here are 4 marked teeth. I extracted No. 1 more than 4 years ago, and I did extract 2 and 3 in last six months. I will extract No. 4 in short future.


Another tooth


While I was waiting, the upper first molar tooth was infected. I did dirty cleaning job every day. I could not stand to live the life like that. I took the sick day on Jan. 8, 2019. I got the appointment, I chose to deep clean instead of extraction.

One month later, this February, I suffered the swollen gum and pain again. I decided to extract the tooth.

This time the extraction was like a horror movie, it was tough to extract a tooth with two pins healthy, one pin infected with the tissue.


Third tooth


The lower second molar tooth right side also has infection, pain. I need to set up an appointment to extract it.

It is like my personal finance. I did not invest time to learn the basics. I use dental insurance but I did not learn the basics of dental health.

It is disaster. I let this happen.

It all started from 2010, I did not extract the tooth ( right maxillary 2nd molar) with infections, a few deep cleaning, a root canal in 2012, followed by the extraction two month later. The infection went so badly and it spreads bacterial and hurt neighborhood tooth gum healthy status.

Actionable Items


It is my personal finance project. I know that those expensive gum surgery, root canal, or other implant are the dentist's playground. It is the way for them to generate income. I chose to suffer those pain and let those teeth living for extra few years; but I did not learn anything. I made wrong decisions.

It is a good plan to read weekly contest top players' source code. I like to advance myself to next level, it is so hard for me to come out good ideas last three months, and also I learn that Leetcode discuss may not be best place for me to learn. I find a new idea which is to study weekly contest code.

Time to change


It is time for me to work on one hard level algorithm a week. I can just choose to work on the hard level algorithm in weekly contest.

I really like those algorithms in the weekly contest. The hard level algorithm in the contest and also the third algorithm I usually do not have time to complete, because I do not come out short and elegant solution. I involve too much detail in the implementation.

How to motivate myself? Think about those huge reward in the salary to work for top 4 software companies. Usually dynamic programming solution is hard level, and it is used to differentiate that you are senior level or just junior level. Why I stop practice dynamic programming? Should I practice one at least a week for fun, and continue to learn things from the problem solving?

Another idea is for me to work on, I need to choose one classical algorithm to ask in the interview. I should ask one dynamic programming algorithm. Usually it is the first algorithm in Google phone screen. I should hold high standard to quickly filter out the interviewee.

Since I schedule four interviews a week as an interviewer on interviewing.io, I can plan to work on dynamic programming algorithm more often this year.


I also should use the opportunity to learn and improve my dynamic programming solving skills.


Open house visit

Introduction


It is my first visit to the open house in the city of Surrey. I had chance to talk to realtor and then I got the documents to read from condo association.


Financial data



It is hard for me to make decision to give an offer. Even though I have saved 20% down payment, but I could not get the loan from the bank. $225,000 dollars, $80,000 dollar below market value, but $180,000 Canadian dollar mortgage is not not easy to be approved just after the stress test is released shortly.

Introduction


It is time for me to go out to Surrey, and I like to visit open house from 2:00 PM - 4:00 PM. I like to see how many I can visit in one road trip.
