Evan Smith is a corporate attorney working for Hackett Cropper Klein. After being informed by Joe Henderson that Liberty Rail was responsible for the crash, Mike Ross of Pearson Specter Litt attempted to strong-arm Evan into a settlement and an admission, although she refused, presenting Mike with evidence that Joe was a repeat whistle-blower who constantly filed lawsuits in order to become wealthy. After Donna Paulsen impersonated a NTSB member to unlawfully gain Liberty Rail files, Harvey Specter and Mike demanded financial compensation and an admission; however, Evan showed Harvey footage of Donna's actions, informed him that not only would there be no settlement, but that she would report Donna's crime to District Attorney Terrence Wolf.[1]
In an attempt to protect Donna, Harvey met with Evan and offered to drop the case in exchange for dropping the charges against Donna, although Evan refused. After Mike discovered that Liberty Rail had paid off Joe and train conductor Michael Jaworski, Harvey financially supported the two to get them on his side, allowing him to file a new lawsuit and subpoena the files Donna stole, which would then become admissible and damage Liberty Rail; in addition, Evan would be unable to work as she would have to in trials defending herself for a few years, as Jaworski was stating it was Evan and not Liberty Rail who covered up the train incident. Harvey offered Evan the chance to have the charges against Liberty Rail and herself dropped if she committed obstruction of justice to recant the Liberty Rail employee testifying against Donna, which she accepted.[2]
After Mike was being prosecuted for fraud by Anita Gibbs, Harvey made a deal with Evan where Evan would give him incriminating files on Liberty Rail in exchange for Evan being allowed to poach associates and clients from Pearson Specter Litt, which Harvey agreed to since the associates and clients were leaving them anyways.[3
