This Agreement between the above and Air Around the Clock for the purpose of providing preventive maintenance on the above Air Conditioning Equipment at the above address. Routine inspection will follow factory recommended procedures and will include the following check list as applicable to your air conditioning system: WE WILL PROVIDE 100% LABOR TO PERFORM THE ROUTINE PREVENTIVE MAINTENANCE ONLY. • NO SERVICE CHARGE FOR AIR CONDITIONING. • WE WILL PROVIDE AIR CONDITIONING REPAIRS AT A 10% DISCOUNT. • ALL LABOR, PARTS & MATERIALS REQUIRED FOR REPAIRS OR EMERGENCY SERVICE WILL. BE CHARGED TO YOU AT OUR STANDARD RATES, LESS A DISCOUNT OF 10%. • WE WILL GIVE A 10% DISCOUNT TOWARDS ANY NEW AIR-CONDITIONING PURCHASE. • “PREFERENTIAL” SERVICE OVER ALL OTHER TYPES OF SERVICE ACTIVITY. • INSTRUCT YOU IN THE OPERATION OF THE EQUIPMENT TO PROVIDE THE GREATEST OPERATING EFFICIENCY. Regularly Inspect the equipment Two (2) times per year. Furnish you with a completed copy of the service technician’s GENERAL CONDITIONS FOR MAINTENANCE AGREEMENT A. Repairs will not be made without the owner’s approval. B. All work shall be performed during regular business hours which are Monday – Friday 8:00 am to 5:00 pm, Saturday 8:00 AM to 12:00 PM Service calls made after normal business hours will be charged to the customer at a discounted emergency charge rate. Customers will be advised of the charge at the time the service call is scheduled. Service calls made between normal business hours will be included. C: AIR AROUND THE CLOCK shall not be responsible for any loss, damage, or injury due to any delay in rendering service under this agreement, and in no event shall be liable for consequential damages. D. AIR AROUND THE CLOCK will endeavor to have all necessary parts and compressors available promptly to satisfy the customer’s call for service but will not be responsible for extra expense incurred in the expediting of parts or repair of equipment. E. Loss or damage from intervening external causes and other complaints which are not covered by this agreement shall include but are not limited to: 1. Resulting from fire, water (flood), windstorm, lightning, theft, misuse, abuse, or any Act of God. 2. Service required by external causes such as defective or inadequate plumbing, water, power supply (including but not limited to blown fuses, weak circuit breakers or burned out disconnects), duct work and improper settings of control devices (including but not limited to: thermostats, humidistats, or timers). 3. Services made mandatory by changes in regulations of Federal, State or Local Governmental bodies or agencies. 4. The refinishing or replacement of any cabinet or cabinet parts. 5. Service required because of dirty filters and improper setting or adjustment of grills. 6. Duct work and adjustment of grills as well as noise complaints which are not the result of improper functioning of the air conditioning equipment. Service calls are not directly due to mechanical or electrical faults in the air conditioning system 7. Water piping, hoses and valves are not included as parts of the air conditioning system on water cooled units covered by this agreement. 8. Work performed by any other than our technicians while contract is in effect. 9. Service required for leaks in refrigerant, water and condensate piping concealed in walls, floors, or ceiling. 10. Work necessary to gain access to equipment. F. AIR AROUND THE CLOCK reserves the right to advise customers when the air conditioning system is obsolete and non-repairable, or ATC’S opinion the AC is not worth putting repair money into due to age, condition or efficiency of existing equipment. G. There is an administrative fee of fifty dollars ($50.00) to Transfer the Contract to a different residence or homeowner. H: ATC is not responsible for any damages caused by clogged drain lines, or any leaking water damages, including but not limited to wood floors, drywall or ceiling damages caused by water leaking. ATC is not responsible for damages caused by drain lines coming apart inside walls. ATC will take every precaution necessary to clear drain lines but cannot guarantee any existing drain lines. It is the customer’s responsibility to schedule the maintenance call. As a courtesy we may try to schedule them. The rates charged for this contract are not regulated by the Florida Department of Insurance Regulation - Cancellation by the Customer: You may cancel this Contract at any time. To cancel, you must mail this Contract or provide written notice Around the Clock A/C Service LLC. If you cancel this Contract within the first thirty (30) days, you will receive a 90% refund of the Contract purchase price less any discounts received. If you cancel this Contract after thirty (30) days, a pro-rata premium refund will be made based upon the time used, and discounts received, less an administrative fee of fifty dollars ($50.00) or ten percent (10%) whichever is less. All refunds will be paid to you. - Cancellation by Us: We may cancel this Contract for any reason within the first thirty (30) days. After thirty (30) days, we may cancel this Contract: - If you have failed to maintain your Air Conditioning system as prescribed by the manufacturer; - If you have not paid for the Contract. - If there are excessive nuisance calls - If we cancel this Contract, you will receive 100% of the paid unearned pro-rata premium, less any discounts or work performed, less a $50.00 administrative fee. If discounts applied are more than contract cost, no refund will be due to customer. Normal maintenance price for maintaining AC units is $195.00 per AC unit maintained and will be deducted off any refunds. Any balance of refunds will be paid to you. |
